Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and GammaLens LLC (“GammaLens,” “we,” “us,” or “our”), governing your access to and use of the GammaLens website at gammalens.io, the GammaLens dashboard, and all related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

2. Description of Service

GammaLens provides options market structure analytics, including but not limited to gamma exposure (GEX) data, delta exposure (DEX), vega exposure (VEX), structural level calculations, AI-generated market insights, and related educational tools and content (the “Service”).

The Service is offered in multiple tiers: Free, Pro, and Founder, each with different feature sets and pricing as described on our pricing page. We reserve the right to modify, add, or remove features from any tier at any time.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account. GammaLens will not be liable for any loss or damage arising from your failure to maintain the security of your account.

5. Subscription Plans and Billing

Free Plan. The Free plan provides limited access to SPY and QQQ data at no cost. No credit card is required. The Free plan may be modified or discontinued at our discretion with reasonable notice.

Paid Plans. Pro and Founder plans are available on monthly or annual billing cycles. Prices are listed on our pricing page and are subject to change. For annual plans, the full annual amount is charged at the beginning of each billing cycle.

Free Trial. Paid plans may include a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your payment method will be charged the applicable subscription fee.

Founder Plan. The Founder plan is limited to the first 100 subscribers. Founder pricing is locked for the duration of your continuous subscription. If you cancel and later resubscribe, the Founder rate is not guaranteed and you will be subject to the then-current pricing.

Automatic Renewal. Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You may cancel at any time through your account settings.

Refunds. We offer a 30-day money-back guarantee on all paid plans. If you are not satisfied within the first 30 days, contact support@gammalens.com for a full refund. After 30 days, refunds are issued on a prorated basis at our discretion.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
• Scrape, crawl, or use automated means to access the Service or extract data, except through our publicly available API (if any) in accordance with its terms.
• Redistribute, resell, sublicense, or commercially exploit the data, analytics, or content provided by the Service without our prior written consent.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks.
• Use the Service to transmit viruses, malware, or other harmful code.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Share your account credentials with third parties or allow multiple individuals to use a single account.

7. Intellectual Property

The Service, including all content, features, functionality, software, designs, text, graphics, and trademarks, is owned by GammaLens LLC and is protected by United States and international intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial trading and analysis purposes. This license does not include the right to reproduce, distribute, or create derivative works from any content provided by the Service.

8. Data and Accuracy

GammaLens sources options data from third-party data providers. While we strive to provide accurate and timely information, we do not guarantee the accuracy, completeness, or timeliness of any data displayed on the Service.

Options data, structural levels, AI insights, and all analytics provided by the Service are derived from mathematical models and algorithms. These calculations involve assumptions and simplifications that may not reflect actual market conditions. Past performance of any structural level or model prediction does not guarantee future results.

Data refresh rates vary by subscription tier. Free plan data may be delayed by up to 30 minutes. Pro and Founder plan data refreshes approximately every 5 minutes during market hours. Real-time data is not guaranteed.

9. Not Investment Advice

THE SERVICE IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. NOTHING ON THE SERVICE CONSTITUTES INVESTMENT ADVICE, FINANCIAL ADVICE, TRADING ADVICE, OR ANY OTHER SORT OF ADVICE, AND YOU SHOULD NOT TREAT ANY OF THE SERVICE'S CONTENT AS SUCH.

GammaLens does not recommend that any securities, options, or other financial instruments be bought, sold, or held by you. Trading decisions should be made based on your own research and judgment. You should consult with a qualified financial advisor before making any investment decisions.

Options trading involves substantial risk of loss and is not suitable for all investors. You could lose more than your initial investment. The use of leverage in options trading can magnify both gains and losses.

10. AI-Generated Content

Certain features of the Service, including “AI Market Insights,” use artificial intelligence and machine learning models to generate analysis and commentary. AI-generated content is probabilistic, may contain errors, and should not be relied upon as the sole basis for any trading or investment decision.

AI-generated insights reflect patterns in data at the time of generation and do not account for breaking news, geopolitical events, or other factors that may materially affect market conditions.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAMMALENS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

YOU SPECIFICALLY ACKNOWLEDGE THAT GAMMALENS SHALL NOT BE LIABLE FOR ANY LOSSES OR DAMAGES ARISING FROM YOUR TRADING OR INVESTMENT DECISIONS, WHETHER OR NOT SUCH DECISIONS WERE INFORMED BY DATA OR ANALYSIS PROVIDED BY THE SERVICE.

13. Indemnification

You agree to indemnify, defend, and hold harmless GammaLens LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by canceling your subscription through your account settings or by contacting support@gammalens.com.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New Jersey, and you consent to personal jurisdiction in such courts.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GammaLens LLC regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
